The Artist’s Club is committed to protecting your privacy and providing you with web products and services that allow for a secure online experience. This privacy statement applies to this website, and by using this website, you consent to the data practices described in this statement.

Laws and data collection

The Artist’s Club comes under data collection laws in various countries and locals. Our privacy policy meets the requirements of the following acts:

  • Australia: The Australian Privacy Act 1988 (Privacy Act) and the Australian Privacy Principles (APPs) regulates the handling of personal information about individuals.
  • European Union: The European General Data Protection Regulations (GDPR) applies to businesses in Australia or overseas if their business or website collects European consumer data. 
  • Canada: The Canadian Personal Information Protection and Electronic Documents Acts (PIPEDA) applies to businesses in Australia or overseas if their business or website collects Canadian consumer data. 
  • California: California has two policies; COPPA and CALOPPA, both of these apply to businesses in Australia or overseas if their business collects Californian consumer data.

Data collection

During sign up we collect your name and address, email address, ip address, and browser information. This information is kept by us, only on our server and is only accessed by our approved staff. This information may be provided to government agencies if requested.

All users can see, edit, or delete their personal information at any time (except they cannot change their username). Our website administrators can also see and edit that information.

When you cancel your membership and delete your account we no longer keep your personal information. Your comments, posts and artworks will be deleted.

Information about your credit cards is kept by Stripe (Stripe privacy policy) or Paypal (PayPal privacy policy) under their terms and conditions, and their privacy policies. When you make the payment you are agreeing to their terms and conditions. The Artist’s Club has no access to these details, as they are handled by these third parties.

We collect your name and email address on sign up with Mailchimp (Intuit) so that we can contact you via email. Mailchimp has a very robust privacy policy. (Mailchimp Privacy Policy). We ask you to join our mailing list for offical communications with our artists club members. We keep the names and email address of all members in mail chimp. You can opt in or out of our offical communications. We only envision that these will be occasional, for example when we update the terms and conditions or add new features.

Our secure server is hosted by Vice Temple and is located in the European Union in Amsterdam (ViceTemple privacy policy).

Data sharing

The Artists Club will share your data it has with relevant legal authorities only when formally requested by law or in corporation with offical legal enquiries.

Communications

The Artists Club will endeavour to communicate with you as little as possible. The amount of emails and notifications from the club can be controlled in your membership. (located at Account / Notification Settings)

The Artists Club will irregularly communicate with you officially from our mail chimp mailing list. This is for offical and important announcements only. You can opt out of this email if you wish.

Comments

When members leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Members of the website can download and extract any location data from images on the website.

Cookies

If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.

Embedded content from other websites

Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.

These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.

Who we share your data with

If you request a password reset, your IP address will be included in the reset email.

How long we retain your data

When you engage in the community, leave a comment, post an artwork or a link, we keep that information on the site for others to see indefinitely, or until that you asks us to permently delete your account.

If you register as a member on our website, we store the personal information you provide in your user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

What rights you have over your data

If you have an account on this site, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.
